Purchases made in MediaMax B2B SLU are subject to the general conditions of purchase, contained in the page, at the time of the corresponding purchase order. The formalization of an order implies full acceptance of them. These conditions of purchase have been exposed in advance, in accordance with current legislation.

After your registration as a customer and validation by us, you will be able to make your purchases on the website quickly and easily. Before making your first purchase, please contact us for validation before making your first purchase.

Prices

Prices do not include 21% VAT, nor shipping costs, as they will depend directly on the chosen payment method and the amount of your purchase. As soon as you have chosen your items, you will immediately be able to obtain the quotation on the order completion page.

The prices shown on the mediamax.com website are to be considered purely indicative and do not constitute a binding commitment to sell. The actual selling price will be specified on the order receipt certificate or order confirmation. MediaMax B2B S.L.U. reserves the right to modify prices and discounts at any time without prior notice.

Furthermore, MediaMax B2B S.L.U. reserves the right to cancel any order, in which a price has been erroneously published that is lower than the correct price by 10% or more, or by an amount that is clearly irrelevant or recognisable as an error, for whatever reason (system errors, human error, etc.). This also applies in the case of an initial order validation. The product will not be delivered unless the buyer decides to proceed with the order anyway, and agrees to pay the correct price.

Shipping costs and delivery commitment:

The delivery time of your order will depend on the service you contract and its availability. MediaMax B2B SLU will process, on the same day, all orders placed and paid from Monday to Friday until 14:00h, one hour less in the Canary Islands, throughout the year. Orders placed during the weekend or on public holidays will be processed on the next working day.

For items that are not in stock, an additional 2 working days must be added to the established deadlines. In any case, we will notify you of any updates to the status of your order.

User responsibility

The user or customer is responsible for verifying before placing the order that the delivery address is correct and that it includes all the data necessary for delivery, including street, number, floor, door, postcode, province, municipality and country.

In the event that the delivery address is incorrect, MediaMax B2B SLU will not be liable for delays in delivery, nor for any additional shipping costs to complete the delivery to the correct address. The customer may choose to pay the increased shipping cost or request a refund of the order, from which the costs of delivery to the wrong address will be deducted, even if the order had the promotion of free shipping costs applied, since the order could not be completed due to negligence on the part of the customer.

Important: Shipments to the Canary Islands, Ceuta, Melilla and countries outside the EEC have customs costs not indicated. Please note that the agency, upon delivery of your order, will ask you to pay these costs.

Methods of payment

MediaMax B2B SLU allows you to use different payment methods to complete your purchase depending on the customer's needs, among which are the following:

Once the order has been paid and confirmed, the purchase invoice will be sent to you by e-mail in a predefined form, so that you can have it at your disposal wherever and whenever you want and, moreover, in order to preserve the environment.

Guarantees on your purchase

MediaMax B2B SLU, guarantees according to the laws in force and the following conditions all the articles it sells. In any case, MediaMax will be liable for the lack of conformity of new products that become apparent within three years of delivery and as a subsidiary responsible, the manufacturer. It shall also be liable for any non-conformity of products sold as reconditioned or pre-owned which becomes apparent within a maximum period of one year, in accordance with the legislation in force.

In the event that the purchased good is not in conformity, the consumer shall have the right to choose between demanding repair or replacement of the good, provided that the former is not possible. In both cases, the collection and processing of the guarantee shall be free of charge for the customer and shall be carried out within a reasonable period of time, unless it is impossible or disproportionate.

If, once the repair has been completed and the goods have been delivered, they are still not in conformity with the contract, the buyer may demand the replacement of the goods, a reduction of the price or the termination of the contract in accordance with the provisions of the law. During the six months following the delivery of the repaired goods, the seller shall be liable for the lack of conformity that led to the repair.

If the replacement fails to bring the goods into conformity with the contract, the buyer may require the goods to be repaired, the price to be reduced or the contract to be rescinded in accordance with the provisions of the law. The price reduction and rescission of the contract shall take place, at the consumer's choice, if the consumer is unable to demand the repair or replacement and if the repair or replacement has not been carried out within a reasonable time or without major inconvenience to the consumer. Termination shall not apply where the lack of conformity is minor.

In the absence of proof to the contrary, lack of conformity which becomes apparent within six months of delivery shall be presumed to have existed when the thing was delivered, except where this presumption is incompatible with the nature of the good or the nature of the lack of conformity.

The consumer shall inform the seller of the lack of conformity within two months of becoming aware of it. In the absence of proof to the contrary, the consumer's communication shall be deemed to have taken place within that period.

Reparation and replacement suspend the calculation of the time limits for the exercise of the actions referred to in this law. That is to say, the time from the notification of the lack of conformity and its complete resolution will be added to the remaining time of the legal guarantee of 3 years.

In order to make this warranty effective, the presentation of the corresponding purchase invoice is a prerequisite. The customer shall lose the right to warranty if the product does not comply with the manufacturer's limited warranty conditions. Any physical damage, damage due to humidity or exposure to water, or damage due to improper handling by the end user invalidates the warranty.

Processing of the guarantee

All the items we sell have the following warranties:

Manufacturer's warranty

For mobile phones and electronic items considered "non-consumable" the official manufacturer's warranty is 3 years from the date of purchase by the end customer. Depending on the manufacturer, phone accessories are guaranteed for 1 year.

Any Official Technical Assistance Service (TAS) of the brand that is in your town, or anywhere in Spain or Europe, can take charge of the repair in case of failure, looking for your convenience so that you do not have to send us the article to repair it. Contact us if you would like to know the nearest TSS in your area or call the brand's customer service telephone number. The SAT will not charge you anything as long as the fault detected is covered by the warranty. Always enclose the purchase invoice that is sent with the phone.

MediaMax B2B SLU will never take responsibility for repairs, as long as there is an authorised service centre in Spain. MediaMax will be able to advise you and put you in contact with technical services, but will not be responsible for the repair.

If there is no SAT of the brand of the item you purchased in Spain, MediaMax will be in charge of managing the repair, as long as the fault is a manufacturing fault. The shipping costs in this case are shared (you pay the shipping to our warehouse).

MediaMax will only accept returns of defective or DOA products. Before returning any item, you must contact our customer service via email at customer@mediamax.es or by calling +34 965 14 56 67 to record the return.

Management of DOAs

Before returning any item, you must contact our customer service department by email at customer@mediamax.es or by calling +34 965 145 667, in order to have proof of the return.

For a defective item to be considered DOA it must meet ALL of the following requirements:

  • Invoice date of purchase less than 30 days.

  • Date of sale to final customer less than 15 days.

  • Item in optimal condition*..

*It must be returned in the same condition in which it was received, keeping all packaging, accessories, manuals, wrappings, without visible external defects (scratches, bumps, etc...).

If the above requirements are met, MediaMax will send the agency to collect the product, at the address where it was delivered.

After receiving the product in our warehouses, MediaMax will proceed to carry out a series of checks to certify its condition. If it is confirmed that the product is defective and meets the conditions mentioned above, a new product will be sent to you, free of charge.

Applicable law

Purchases made in MediaMax are subject to current Spanish legislation and other concordant legislation, with purchases being understood to be made in MediaMax B2B SLU with VAT: B16403453 and registered office at Av. Aguilera 47 bajo. 03007 Alicante, España.

With respect to any discrepancy or divergence that may arise regarding the fulfilment or interpretation of the purchase agreement reached, or any of its conditions, the parties submit to the Courts and Tribunals of Alicante.

The declaration of nullity of one or more of the non-essential conditions of purchase shall not entail the nullity of the purchase agreement reached, which shall remain in force.
